Rule 1 - Name, HQ, and Jurisdiction 

The name, headquarters and jurisdiction of this Branch are as defined in the writ of jurisdiction issued by the Board of Directors of the Customs Excise Union Douanes Accise.

Section 1 
Within the jurisdiction of this Branch, the aims and objects of the Branch shall be to uphold and promote the aims and objects outlined in Customs Excise Union Douanes Accise By-Law 2. 
Section 2 
The Branch shall not seek affiliation with any political parties.

Section 1 
Within the Branch jurisdiction, membership shall be as defined in Customs Excise Union Douanes Accise By-Law 3. 

Section 2 
Only members and life members who are otherwise eligible shall: 

1.

vote on any matter at meetings of the Branch; 

2.

hold office in the Branch; 

3.

be elected or appointed a delegate representing the Branch.

Membership Rights and Responsibilities shall be as defined in the By-Laws of the Customs Excise Union Douanes Accise.

Membership Discipline and Appeal Procedure shall be as defined in Customs Excise Union Douanes Accise By-Law 5.

Membership dues shall be in accordance with By-Law 6 of the Customs Excise Union Douanes Accise providing the Branch share of the funds.

The Branch Executive shall consist of: 

a.

The Branch President; 

b.

The two Vice-Presidents; 

c.

The Secretary; 

d.

The Treasurer; and

e.

Executive Stewards as required.

The Stewards Meeting shall comprise the Branch Executive, Chief Stewards and Stewards within the Branch jurisdiction.

(Numbers in parentheses refer to sections in the former Branch Rule 9.)

 

1.  Authorities (9.1)

(a) In accordance with the PSAC Rules of Order;
(b) In accordance with the CEUDA Branch Elections Kit; and
(c) By secret ballot.

 

2.  Plurality of ballots

Determining the election of all Officers of the Branch shall be a plurality of ballots that are: (9.1)

(a) Not spoiled; and (9.2.6.h)
(b) Cast from members in good standing. (9.2.6.g)

 

3.  Conditions of Candidacy (9.2)

Any member in good standing may be a Candidate for any Branch office, subject to the provisions of CEUDA By-Law 5.

       

4.  Term of Office

(1)

All Officers are elected for a term of three years (9.3), with the exception noted in the following Sub-Section. (New - April 2005)

(2) The term normally lasting from 2004/5 to 2007/8 shall be extended by one year to 2008/2009 so that it lasts four years rather than three, following which all terms shall revert to three years so they always end after National Convention.

5.  Executive Officers (9.5)

The following Executive Officers are elected by the membership of the Branch:

(a) Branch President;
(b) Branch Vice-Presidents;
(c) Branch Secretary; and
(d) Branch Treasurer.

 

6.  Executive Stewards (9.6)

The Executive Stewards are elected by the Stewards Meeting at their first meeting following the general elections for the same term as the elected Executive Officers.

 

7.  Chief Stewards (9.7)

The Chief Stewards are elected by the Stewards for the same term as the elected Executive Officers.

 

8.  Stewards

(1) Stewards are elected by the membership in the Division they represent (9.9), for the same term as the elected Executive Officers. (New - April 2005)
(2) Where election of Stewards fails to provide results, Stewards are appointed by the Branch Executive for the same term as the elected Executive Officers. (9.8)

 

9.  Employee Representatives (9.9)

An Employee Representative may be appointed in any office with two (2) or less members in good standing on recommendation of the Chief Steward within the appropriate Division.

 

10. Filling Vacant Positions (9.10)

Should any elective office not be filled by the electoral process prescribed in this Rule, a Stewards meeting shall be called by the Chair of the Nominations Elections Committee (NEC) and those in attendance at the meeting (including members of the Branch Executive (New - April 2005)) shall fill the vacant office.

 

11. Outgoing Executive Remains In Office Until (9.11)

A member of the outgoing Branch Executive remains in office:

(a) Until such time as his/her replacement has been duly:
  (i) Appointed;
  (ii) Acclaimed, if at closure of nominations no other candidate was nominated; or (New - April 2005)
  (iii) Elected; and
(b) Until his/her replacement has been administered the Oath of Office, in keeping with Sections 12 and 25. (New - April 2005)

 

12. Completion of Electoral Process (New - April 2005)

(1)

The electoral process is complete after the vote is counted, at which time elected candidates shall take the oath of office, as per Section 25.

(2) Where all positions in the Branch are acclaimed:
  (a) The electoral process is deemed complete after the close of nominations, at which time acclaimed candidates shall take the oath of office, as per Section 25; and
  (b) The two-week appeals period provided under Section 19, Sub‑Section 5, Paragraph G, begins on the first day after the close of nominations.

 

13. Days (Note on bottom of Section 1)

All references to "days" shall be interpreted as "calendar days".

 

14. Proxy Voting (9.2.6.g)

Voting by proxy shall not be permitted.

 

15. Duties of outgoing Branch Executive

The outgoing Branch Executive shall:

(a) Appoint a Chair and a Secretary for the NEC (9.2.1), no later than one month before the opening date of National Convention. (New - April 2005)
(b) Immediately after appointing a Chair and a Secretary of the NEC, advise the National President as to the names, addresses, and telephone numbers or other pertinent contact information such as e-mails of the appointees. (9.2.2 & 9.5.1)

 

16. NEC Conditions of Office (9.2.3)

Members of the NEC:

(a)

Shall be a member in good standing; (New - April 2005)

(b) Shall not be a Candidate;
(c) Shall not nominate or co-sponsor a nomination;
(d) Shall not accept any other position (such as scrutineer);
(e) Shall remain impartial; and
(f) Shall not reveal candidacies to anyone before the closing date of the nominations period.

 

17. Returning Officers (9.2.4)

The Chair of the NEC shall appoint enough Returning Officers to ensure that all Branch members have the opportunity to submit nominations and to vote.

 

18. Membership of NEC (9.2.6)

The Chair, Secretary, and Returning Officers, shall constitute the NEC.

 

19. Election Timetable (New - April 2005)

(1) The Branch Secretary shall advise the National Office of the names, contact information and addresses of the NEC Chair and Secretary, appointed by the Branch Executive in keeping with Section 15 of this Rule, no later than three weeks prior to opening date of the National Convention.
(2) The National Office shall set one election timetable for all Branches.
(3)

The National Office shall advertise the arrival of Branch elections by posting on the CEUDA National Office website and publishing in the CEUDA Magazine, where possible:

  (a) The election timetable;
  (b) The names, work location, and work telephone numbers of the NEC Chairs and Secretaries for each Branch; and
  (c) Nomination Form (only in the Magazine) and all forms and documents on the website.
(4) The election timetable shall:
  (a) Commence one week prior to National Convention, with the posting of the election timetable; and
  (b) Be completed before the start of Christmas Holidays of each National Convention year.
(5)   The timetable shall have the following dates:

 

  Announcing the Timetable
  (a) A date by which the timetable shall be announced, and this date shall be two weeks before the closing date of the National Convention;
  Nominations Period
  (b) The first and last dates of a two-week nominations period, which would start on the first date after the closing date of the National Convention, followed by the campaigning period;
  Campaigning Period
  (c) The first and last dates of a two-week campaigning period, followed by the voting period;
  Advanced Polling
  (d) The date by which members requiring advanced polling shall advise the NEC Chair of the need for advanced polling, and this date shall be two weeks preceding commencement of the voting period;
  (e) The first and last dates of a one-week advanced polling period, which shall immediately precede the voting period;
  Voting Period
  (f) The first and last dates of a two-week voting period, followed by an appeal period or a tie-breaking voting period,
  Appeal Period for Initial Vote
  (g) The first and last dates of a two-week appeal period, which shall immediately follow:
    (i) The last date of nomination if all candidates are acclaimed, or
    (ii) The voting period if at least one position is being contested;
  Tie-breaking Voting Period
  (h) The first and last dates of a second two-week tie-breaking voting period, followed by an appeal period; and
  Appeal Period for Tie-breaking Vote
  (i) The first and last dates of a second two-week appeal period.

 

20. Duties of NEC

The NEC shall assume all responsibilities for carrying out the electoral process (9.2.6.a) as follows and in keeping with the election timetable established by Section 19:

(a) List of Members
  (i) At the time it posts the election timetable, post a certified list of all members of the Branch based on the most recent information available to the NEC, the latter of which shall examine all claims of error in such list and decide as to the validity of such claims; (9.2.6.b)
(b) Nominations
  (i) Prepare and distribute Nomination Forms; (9.2.6.c)
  (ii) Provide Nominators with a receipt; (9.2.6.c)
  (iii) Assume responsibility for accepting all nominations; (9.2.6.a)
  (iv) Ensure that each Nomination Form:
    (1) Contains the name of one Candidate,
    (2) Is properly signed by the Candidate, his/her Nominator and a Co-nominator; (9.2.6.d)
  (v) Ensure that all Candidates and Nominators are members in good standing (refer to the Definitions page in the Branch Elections Kit); (9.2.6.d)
  (vi) Before the publication and/or posting of Candidates, ensure that all Nomination Forms nominating a single Candidate to various posts be withdrawn, except the Form for the post the Candidate wishes to contest; (9.2.6.e)
  (vii) Immediately following the last date of the nominations period, publish and/or post the list of all Candidates in all work locations of the Branch; (9.2.6.d)
(c) Advanced Polling
  (i) Provide a member unable to vote during the voting period with advanced polling; (9.2.6.a.iii)
(d) Voting
  (i) Provide ballots; (9.2.6.f)
  (ii) Ensure that ballots are distributed to all voting members; (9.2.6.g)
  (iii) Ensure that each member receives only one (1) ballot; (9.2.6.g)
  (iv) Ensure that only members in good standing vote; (9.2.6.g)
  (v) Allow for the disclosure of all balloting times and locations to the Candidates and/or their authorized representatives; (9.2.6.g)
  (vi) Make allowance for each Candidate or his/her authorized representative to be present to witness the balloting process in its entirety; (9.2.6.g)
(e) Counting Ballots
  (i) On the evening of the last date of the voting period, the Chair, Secretary, and one (1) other member of the NEC, shall count all ballots in their possession at 5:00 p.m., without exception.  (9.2.6.h)  This means mail-in ballots shall be received, not just post-marked, by then. (New - April 2005)
  (ii) The NEC:
    (1) Shall ensure that only ballots where the intent is clearly marked in the appropriate place be accepted;
    (2) Shall include in the count the:
      (a) Total number of ballots cast for each Candidate; and
      (b) Number of spoiled ballots; (9.2.6.h)
  (iii) Ensure that Candidates and/or their representatives may be present to witness the count of the ballots; (9.2.6.h)
(f) Results
  (i) On the evening of the last date of the voting period, after counting of ballots is completed, notify all Candidates of the results of the elections; (9.2.6.i)
  (ii) On the first date after the voting period, publish and/or post the names of the successful Candidates in all work locations of the Branch; (9.2.6.i)
(g) Retain Records
  (i) Until the first meeting of the Branch Executive, ensure that all ballots and Nomination Forms be:
   

(a)

Accounted for;

   

(b)

Held by the NEC Chair;

   

(c)

Sealed in a box. (9.2.6.k)

(h)

Reports

  (i) Submit to the National President copies of all reports it generates. (9.5.4)
(i) 2nd Voting Period
  (i) In the event of a tie vote for any office during the first voting period, the NEC shall immediately announce a 2nd voting period. (9.2.6.h)

 

21. Destruction of Ballots (9.2.6.k)

The Branch Executive shall instruct the Branch Secretary to destroy the ballots and retain the nomination forms and any report from the Returning Officer(s) as Branch records.

 

22. Termination of Campaigning (9.2.6.e)

Each Candidate shall put an end to his or her election campaign on the last date of the campaigning period, which precedes the first date of the voting period, as is the case in municipal, provincial or federal elections.

 

23. Appeals or Complaints

(1)

On the first date results of the elections are published and/or posted, an appeal may be presented to the election of the Branch President or to the election of any other Branch Officer. Said appeal is to be presented:

  (a) Within ten (10) calendar days;
  (b) In writing;
  (c) Signed by ten (10) members in good standing;
  (d) Submitted to the CEUDA National President. (9.2.6.j)
(2) Upon receipt of an appeal or a complaint, the National President may appoint a National Vice-President to obtain additional information from the complainants and/or from the Chair or Secretary of the NEC to better assess the validity of the appeal or complaint. (New - April 2005)
(3) When the National President s/he is satisfied about having all the information required to make a decision, s/he may:
  (a) Refer the matter to the Branch Executive, when the appeal or complaint involves any position on the Branch Executive except Branch President; (9.2.6.j.i)
  (b) Refer the matter to the National Executive when the appeal or complaint involves a Branch President. (9.2.6.j.ii)
(4) The National Executive may order new Branch elections to take place for one or more positions (this order can be for a complete or partial election timetable). (New - April 2005)
(5) Decisions on challenges shall be reviewed by the CEUDA National Board of Directors. (9.2.6.j.iii)
(6) In the event of an appeal involving the CEUDA National Executive, all documents in possession of the NEC shall be forwarded to the CEUDA National Office, to be dealt with by the CEUDA National Board of Directors at its next meeting. (9.5.5)

 

24. Dissolution of NEC (9.2.6.i)

The NEC is dissolved at the next regular Stewards meeting in the New Year, following Convention year.

 

25. Administration of Oath (9.2.6.m)

The NEC Chair, or his/her nominee, shall immediately administer the Oath(s) of Office:

(a) To all incoming Officers;
(b) After incoming Officers are appointed, acclaimed, or elected; and
(c) In the presence of at least two (2) members in good standing.

Section 1 
The Branch Executive shall organize the Branch within its jurisdiction, to provide adequate representation for the membership in all aspects of activities and shall make all efforts that gender representation is proportional to the Branch membership of the Customs Excise Union Douanes Accise and the Branch. 
Section 2 
In determining the Branch organization, the Branch Executive is to consider the nature of the work performed, physical and geographic location and the Departmental organizational structure. 
Section 3 
As guidelines for the application of this Rule: 

a.

The Branch Executive may provide for locals where a Chief Steward is responsible for a group of members geographically isolated from the Branch Headquarters. 

b.

Branch Executive may establish a Division when the jurisdiction of a Chief Steward extends over a geographic area of a radius greater than fifty (50) miles from the work site of the Chief Steward. 

c.

A Division should be established for the major Departmental organizations within the Branch, such as Excise Division, Commercial Operations, Airport Operations, Traffic Operations, etc. 

d.

During election to the office of Executive Stewards (Rule 9, Section 1, paragraph 6) the Steward Body must take into account the Divisions stipulated in c) and shall make all efforts to allow gender representation of women and men of the Branch on the Executive, while considering the wishes expressed by the Body. 

e.

Where a Division is not represented on the Branch Executive as a result of Branch elections, the Branch should provide an Executive Steward for that Division.

Section 1 
All officers should hold office until their term of office expires and/or until their successor is duly elected. 

Section 2 

a.

A member of the Branch Executive who is absent without due cause from three (3) consecutive meetings of said Executive, is considered to have abandoned his/her office and is to be relieved of his/her post and replaced by election from the remaining members of the Branch Executive by the Branch Executive and approved by the
Stewards Meeting. 

b.

A Steward who misses three (3) consecutive official Stewards Meetings, without adequate reason, shall be automatically suspended as a Steward. 

Section 3 
If a member of the Branch Executive vacates office for any cause, other than provided for in Section 1, his/her office shall be filled by election as provided in Section 2, Paragraph a). 
Section 4 
If a steward is transferred beyond the jurisdiction of the Branch, he/she shall be considered as vacating his/her post and the remaining portion of his/her term of office is to be filled by his/her successor who shall be named by election. 

Section 5 
In the event of the resignation of the entire Branch Executive, the District Branch will automatically be placed in trusteeship. 

Section 6 

1.

Notwithstanding Section 5, trusteeship may be imposed by the National Executive, whenever it is deemed to be in the best interest of the membership of a Branch or the Union in general. 

2.

The National Vice-President responsible for the Branch will be appointed by the National Executive as Trustee. 

3.

The trusteeship will be administered by a committee of Branch members, known as Deputy Trustees, appointed and supervised by the Trustee. 

4.

The Trustee and Deputy Trustees of the Branch shall be vested with all the powers and authorities and be responsible for all duties provided for under Branch Rules.

5.

All documentation pertaining to the trusteeship shall be provided to members of the Board of Directors as expediently as possible.

The District Branch Executive shall: 

1.

administer the finances of the Branch and plan and direct its affairs, subject to legal and constitutional requirements and direction from and/or approval of the Stewards Meeting; 

2.

report monthly to the Stewards Meeting, regarding the administrative, financial and other activities of the Branch; 

3.

organize the Branch in accordance with Rule 10; 

4.

assume responsibility for and supervise the application of any collective agreement in force applying to the members of the District Branch; 

5.

plan and organize the administrative and clerical work of the Branch and provide the necessary personnel and facilities for the work; and be responsible for the competence of the staff; 

6.

summon special general meetings when necessary; and 

7.

be responsible for Grievances, Grievance Procedure, Appeals, Appeal Procedure, Collective Bargaining Data, Education, Classifications, Recommendations on Constitution, By-Laws and Branch Rules amendments for the members of the Branch, and relating with the appropriate authorities or agencies functioning in each of these areas of responsibility.

Section 1 

The Branch President shall:

1.

preside over all general meetings of the Branch Executive, Stewards Meeting and Membership; 

2.

have the general powers and duties of supervision usually vested in the office of a Chief Executive and without limiting the generality of the foregoing between meetings of the Branch Executive, he/she shall have the full power to act with respect to all matters which come within the jurisdiction of the Branch Executive provided  however, that any action shall be submitted to the next meeting of the Branch Executive for review; 

3.

report monthly to the Branch Executive, all matters within his/her knowledge which concern the interests of the Branch; 

4.

direct and coordinate the work of all Executive Officers; 

5.

interpret the Branch Rules for the administration and management of the Branch; 

6.

ensure that the Branch carries out all directives and policies established by the Customs Excise Union Douanes Accise, in accordance with the authorities provided by the By-Laws; 

7.

call a meeting of the Branch Executive at least once every six (6) months or upon written request of the majority of the Branch Executive;

8.

represent the Branch in all official actions; 

9.

designate Branch Officers to have signing authority for the issuance of cheques jointly with the Treasurer; 

10.

sign all Minutes of meetings and all Financial Reports; 

11.

be responsible for the proper conduct of all Branch affairs and ensure that all members of the Branch Executive and Stewards meetings discharge their duties and their responsibilities. On termination of his/her term of office, surrender or transmit all of the properties, records, funds and documents for which he/she is responsible to the succeeding Executive Officer, within thirty (30) days after the election and Oath of Office of that Executive; 

12.

review and authorize all expenditures for the Branch, except for expenditures made by the Branch President himself/herself, which expenditures must be authorized by the Branch Executive before they are made or, where that is not practicable, approved at the next meeting of the Branch Executive;

13.

prepare a report for the annual Stewards Meeting, accounting for his/her term of office; and 

14.

with the advice and consent of the Branch Executive, appoint a Chair for all Branch committees and specify the duties of such committees.

Section 2 

The Branch Vice-Presidents shall: 

1.

attend all meetings of the Branch; 

2.

carry out the responsibilities delegated to them by the Branch President; and 

3.

have grievance signing authority and the right to represent grievors at all appropriate levels.

Section 3 

The Branch Secretary shall:

1.

be responsible to the Branch Executive for all correspondence and all official documents on record in and for the Branch; 

2.

attend, take notes and prepare Minutes of all Branch Executive meetings, Stewards meetings and General Membership meetings; 

3.

sign Minutes jointly with the Branch President; 

4.

maintain all official records of Branch Minutes of meetings; 

5.

provide notices to all appropriate persons of time, date and place of the Branch Executive, Stewards and General Membership meetings and an agenda, outlining the proposed business for the meeting; 

6.

provide a filing system, such that all records and correspondence are kept with adequate security and are accessible to all authorized Branch Officers; 

7.

on completion of his/her term of office, surrender and transmit all of the properties, records, funds and documents for which he/she is responsible to the succeeding Executive Officer, within thirty (30) days after the election and Oath of Office of that Branch Executive; and

8.

provide a copy of the official Minutes of each Branch Executive meeting to each member of the Branch Executive and to the National President, within thirty (30) days of the date that the Minutes are approved and provide a copy of the official Minutes of any Stewards meetings to each member of the Stewards meeting and to the National President, within thirty (30) days of the date that the Minutes are approved. 

Section 4 

The Branch Treasurer shall:

1.

attend all Branch Executive meetings, Stewards meetings and General Membership meetings; 

2.

receive and account for all funds and financial obligations due to the Branch, or raised in the name of the Branch;

3.

pay all accounts due and payable by the Branch, obtaining and recording all such transactions based on expense accounts and/or statements; 

4.

obtain a receipt for all expenditures; 

5.

present for review and authorization to the Branch President all expenditures for the report of the transaction; 

6.

maintain the financial records of the Branch in acceptable business manner current and available, and provide access to the financial records of the Branch at all meetings of the Branch Executive and Stewards meetings; 

7.

establish the appropriate accounts and deposit all funds belonging to the Branch in the appropriate accounts for safekeeping; 

8.

invest such surplus funds of the Branch in accordance with the instructions of the Branch Executive; 

9.

be required to give a written semi-annual report to the Branch Executive on the financial position of the budget; 

10.

ensure that a budget is prepared no later than sixty (60) days into the new calendar year; 

11.

be one of the signing authorities for all cheques issued by the Branch; and 

12.

at the termination of his/her term of office, surrender and transmit all of the properties, records, funds and documents for which he/she is responsible to the succeeding Executive Officer within thirty (30) days after the election and Oath of Office of that Branch Executive. 

Section 5 

The Executive Steward shall:

1.

attend all meetings of the Branch Executive; 

1.

have the right to voice and vote at all Branch Executive meetings; 

3.

represent the members and Stewards within his/her jurisdiction at meetings of Branch Executive and inform the Branch Executive of all activities within his/her jurisdiction; 

4.

inform Stewards and members within his/her jurisdiction of Branch Executive activities; and 

5.

carry out such other duties as may be assigned to him/her by the Branch President.

Section 6 

The Chief Steward shall:

1.

be responsible for the Stewards and Employee Representatives in his/her assigned area of jurisdiction; 

2.

represent the members in the first step of the Grievance and Union/Management Procedure; 

3.

advise and recommend regarding the rights and privileges in connection with the Public Service Terms and Conditions of Employment and the collective agreements in force in his/her area of jurisdiction; 

4.

provide adequate systems of records of grievances and appeals for his/her area of jurisdiction; 

5.

participate in the transmission of grievance records and appeal records through the Branch and the National structure;

6.

represent the members in his/her area of jurisdiction in all aspects of their interest and welfare at Stewards meetings; 

7.

be responsible for authorizing grievances under the collective agreements when and where such authority is delegated, in writing, from the Branch Executive and the National President of the Customs Excise Union Douanes Accise; 

8.

participate in consultation and Union/Management Meetings at the first or local level; and

9.

hold meetings in accordance with Rule 14, Section 7, at least once monthly and preceding any local Union/Management or Stewards meeting.

Section 7 

The Steward is to be the representative of one or more work units as determined under Rule 10. 

Duties:

1.

advise the membership committee of any change in personnel within the work unit(s); 

2.

obtain signed membership cards for enrolment of employees in the Customs Excise Union Douanes Accise, Public Service Alliance of Canada; 

3.

coordinate the activities of Employee Representatives where such persons have been selected; 

4.

ensure that all informational bulletins and other forms of Union communications are circulated to the members; 

5.

advise and explain the members' rights and roles within the meaning of the PSAC Constitution, CEUDA By-Laws and Branch Rules;
